Pics of battered Gabriel Aubry released

Los Angeles - The Los Angeles Superior Court has released pictures of a battered Gabriel Aubry following a brawl between him and Olivier Martinez on 22 November, reports The Daily Mail.

The fight came after Gabriel's ex, Halle Berry, recently had her attempt to move their daughter Nahla to France with her and fiancé Martinez, denied by a judge.

The incident took place after Gabriel dropped Nahla at Halle's Los Angeles home for Thanksgiving.

According to Reuters, Gabriel has since claimed that he had been the victim of the fight. After the pictures of Gabriel were released by the court, another side to the story was revealed.

Before being arrested and charged with battery and assault, Gabriel was sent to the hospital where he was treated for broken ribs and several open cuts.

In the photos, Gabriel is sporting a black eye, various cuts along his cheeks, face, lips and eyes as well as grazes on the bridge of his nose. Photos of his hands were also released and show bloody fingernails and bruises caused by the fight.

"I suffered numerous injuries as a result of the attack, including a fractured rib, multiple bruises on my face and a number of cuts which required stitches," Gabriel said in court papers, alleging that Olivier had threatened to kill him the day before.

"It all happened so fast and so suddenly; I did not see Mr Martinez's actions coming and thus I was not ready for it and was not able to defend myself," Gabriel wrote in the statement.

CCTV footage proves innocence

Gabriel was awarded a restraining order against Olivier on Monday.

TMZ has revealed that the order will only be in effect until 17 December. He has also since then been ordered to stay away from Halle, Olivier and Nahla.

The Daily Mail reports that in his statement to the police, Gabriel alleged that Olivier had whispered in his ear the previous day at Nahla's school play, saying: "I wish I could beat the shit out of you right now. You're lucky we're in a school right now. We're going to take Nahla and you're not going to follow us."

It was only the next the day, when Gabriel went to drop Nahla off at Berry's Los Angeles home, that he was greeted by Olivier who claimed he "wanted to talk".

Gabriel described the incident, saying that Olivier walked him to his car and pushed him to the ground, before he hit his head into the driveway and started punching him. Gabriel says that "he was the victim" and that "he only defended himself".

To prove his innocence, Gabriel is hoping to obtain CCTV footage of the incident from Halle's home, which will show that Olivier attacked him.
