Jurie Els can still sue Robbie Klay

Johannesburg - The fact that Jurie Els issued a summons for R5.5m against Media24 doesn't mean that Robbie Klay will escape a summons, Els's lawyer said on Sunday.

Els claims R4.5 million for alleged loss of income and R1m for alleged defamation from Media24 and Esmaré Weideman, currently chief editor of magazines Huisgenoot, YOU and Drum.

The claim stems from articles published in Huisgenoot, YOU, Rapport and Die Burger.

It dealt with allegations by Klay that Els had sexually molested him as a child. Els has been acquitted on all the charges against him.

Advocate Danie Dorfling, Els’s counsel, over the weekend said that the Media24 summons by no means serves as a decision by Els to not sue Klay.

"I can confirm that at this stage I have not received any instructions from Jurie or his lawyers to sue Klay.

"It does not however mean that a summons against Klay is out of the question. We will first pay attention to the present summons and then take some time to decide about Klay. "

Koos van der Merwe, Klay's legal counsel during his case against Els, said past statements that Klay will sue Els over the alleged molestation has not been let go.

"In principle we decided that we will wait for Jurie’s summons against Robbie and then put in a counterclaim against Jurie."
