TopTV to launch porn over Xmas - reports

Cape Town – TopTV is intent on fully launching its separate porn package of three hardcore pornography TV channels "this month still", TopTV's senior manager of regulatory affairs, Thato Mahapa, has said.

Meanwhile, the pay TV operator has received no approval from South Africa's regulator, and is now on a direct collision course with the authority.

Mahapa said TopTV hopes to launch its porn package "this month still", possibly indicating a launch over Christmas.

Conflicting reports

However, TopTV's spokesperson Melinda Connor told Channel24: "We can confirm that we'll not be launching in December. We will announce the launch date closer to the time."

TopTV has now upset South Africa's broadcasting regulator, the Independent Communications Authority of South Africa (Icasa), saying TopTV has the right to launch its porn channels.

Icasa has not issued a certificate of approval giving TopTV permission to launch any new TV channels. TopTV and Icasa are now heading for a major fight over the Playboy TV channels.

'Already authorised'

TopTV's Thato Mahapa said the porn channels are "by default already authorised", alleging that Icasa failed to give a decision on the application within the 60-day period.

Yet TopTV's "application for authorisation of channels" only appeared in the Government Gazette on November 17. According to volume 557, no 34760, all interested parties had 14 days to make written representations in relation to the specific application with Icasa.

After that, Icasa can decide to have a public hearing regarding the application and all the written representations received.

Icasa spokesperson Paseka Maleka told Channel24 that “the authority is currently considering all the submissions received in respect to the TopTV application.

"The date for public hearings has not been set as yet but an official communique will be issued in due course.

"The authority received written representations from members of the public following the publication of the ODM channel authorisation application in the Government Gazette. The authority is awaiting written responses from ODM and thereafter a public hearing will be convened.

"It is within the authority's right to institute further engagements on matters of regulatory nature to ensure that decisions are lawful, reasonable and procedurally fair. The ODM case is no exception. It will be unfortunate if ODM opts to disregard the public consultation process that is currently underway and which it is very much aware of,” Maleka said.

TopTV's Mahapa said TopTV believes, due to technicalities, that "the channels are automatically approved".

"It is us who warned Icasa of its non-compliance with the regulations and they did not listen.

"Secondly, we warned Icasa of the consequences of non-adherence to the regulations, including automatic approval of the channels by virtue of regulations 3.5, and Icasa chose not to heed the call."

He said that TopTV "always has and will continue to adhere to existing regulations".

Agreement signed

TopTV applied for three pornographic channels - or as the industry euphemistically refer to them, "adult channels", after the pay TV operator signed a carriage agreement with Playboy TV.

The Playboy channels will have a separate subscription fee of R199 per month for the three 24-hour channels.

They conned folk into signing with them by promising to be a family entertainment pay tv. They lied. I have no interest in them. They're substandard in qu*lity and content anyway. Top tv is a waste of money.

      Sheik - 2011-12-14 16:48

You'll enjoy it, when no ones around.

      Guy - 2012-01-13 09:32

Does adding "Pastor" to your name here somehow increase the weight and importance of your opinion? And I agree with Sheik, you will enjoy it when no one's around.

Welcome to the real world South Africa, where everyone can choose what he/she wants to watch on TV. I choose not to watch endless TV evangelists, you might not want to watch the porn movies I enjoy. And the result is that I don't watch what you watch and you don't watch what i watch. Everybody happy.

  • Steven - 2011-12-14 16:25

Last time i checked it was a "free" country? No where does it say you'll be bulldozed into watching porn. SEPARATE SUBSCRIPTION OF R199. If you don't want it, don't get! As simple as that.

  • Corrie - 2011-12-14 16:27

This is a disgrase. What is going on in South Africa, is there not enough rubbish going on. One of our normal TV channels has porn after 11pm, why must I be subjected to that although I am paying exactly the same amount as others? Why can I not watch this channel like every body when there is a good movie, but being interupted by this filth. (think I am a prude? gues what "been there, done that and has the TShirt" and know's what this does to people. Thank God I saw the light before I was totally consumed by this mess.

      Charles - 2011-12-14 16:30

No Corrie. You don't have to be 'subjected' to it. There's this great thing called a Remote Control. Try it

      Shadho - 2011-12-14 16:34

WTF Corrie its a subscription service you eejit, if you dont want to watch you dont pay, what a load of bs you posted. geezsus get a life and wtf cares how it affects you....grrr!!! Go live on a plot in timbukto and you can watch the ants procreate....grr!!

      adambrettward - 2011-12-14 16:51

How exactly are you paying exactly the same as others? I hope you're not referring to your TV License, because that has nothing to do with what's on e-tv... And if you're referring to the extra R199 - why the hell are you paying it if you don't want to watch it?

      Sheik - 2011-12-14 16:52

That what you watching is fake sex, and anyway why are you watching TV after 11 PM at night then the next day is a working day.?

  • Pulverturm - 2011-12-14 16:28

R199!! That's expensive, I've changed my mind, they can keep their overpriced porn!

      Shadho - 2011-12-14 16:42

divide 30 days by 24 and then by 60 mins.It must be cheapest porn around LOL!!!! what does a DVD cost you to rent and its over in +- a hr and half??.....Go Top TV get it ON ,lmao...

      jowza1 - 2011-12-14 16:45

same here.for R300.00 you can get a full house from a thai hooker

      Shadho - 2011-12-14 16:59

  • Gerda - 2011-12-14 19:44

NOW THAT is a reason to toyi toyi. Can all the unions for once be united and down tools to participate in a march to this Top TV's office and also ...... the rest of subscribers to boycott payment until this porn channel is either history before it was launched or stopped in its early tracks.

  • Shaun - 2011-12-15 07:37

TopTV will now be seen as a now "go area" and DSTV will laugh all the way to the bank, by getting a 'slice' of the 300 000 toptv subscribers. this must be the most stupid manual of how to destroy your company, toptv dumb-asses! and over christmas what christian will accept this? - cheers

  • Preshen - 2011-12-15 08:11

It’s the season to be jolly

  • Jonathan - 2011-12-19 08:44

The porn is not that important to me and I will not subscribe, but the freedom of speech is not negotiable. Don't ever allow others to decide for you what you should see, say or think. You pay- you watch, you don't pay- you don't watch. Very easy.
