Cape Town - Joost van der Westhuizen’s estranged wife, Amor Vittone, says she has a right to know what is going on with his last will and testament because she is worried about her and their children’s future, Netwerk24 reported.
Van der Westhuizen died almost four months ago and his estate still hasn’t been officially registered.
Ferdi Hartzenberg, Joost and his brother Pieter van der Westhuizen’s lawyer, told Rapport at the weekend that he would be launching an urgent court application that the ex-Bok's last will be declared valid.
The problem with the will is that Van der Westhuizen, who had Motor Neuron Disease, didn’t sign it because he had by then been unable to hold a pen.
The Master of the High Court had refused to accept the will.
A signed will exists which Van der Westhuizen drew up years ago and in which Vittone and their children are the beneficiaries.
Vittone said on Thursday she had a right to know what was going on. “I have to decide if I must sell the house or not,” she said.
At the moment Vittone can’t afford to stay in the house.
She says she doesn’t think Joost would have wanted things about the will to get so “ugly” and that she wants to protect his legacy as the father of their children.
“But what must I do if I have no certainty about my children’s future?
“In the last five years of his life, Joost promised the children that they would never have to worry about money.
“The last thing my children need now is to be moved from the environment they know after losing their father.”
She said the children realised she was worried about their finances. “They are asking: ‘Mom, why are you crying?,”
They also want to know about all her appointments with the lawyers. “Then I say to them: ‘I am fighting for you. All you have to do, is to pray and believe in Jesus’.”
