Los Angeles - Amanda Bynes is set to remain under a conservatorship.
A lawyer claiming to represent the 28-year-old actress, who was released from a psychiatric treatment facility in Pasadena, California on Thursday after being involuntarily committed on 10 October, asked a judge to remove Lynn Bynes' ability to make decisions on the troubled star's behalf on Friday.
But the judge ruled that the Easy A star lacked the capacity to enter into a binding contract or hire a lawyer, so he refused to allow the hearing to go ahead.
He also ruled that Amanda will remain under her mother's care via the conservatorship, according to gossip website TMZ.com.
Despite claiming on Twitter on Friday morning that she planned to fight to regain control of her life, Amanda did not show up to court, but was spotted having lunch in Mel's Drive-In in Hollywood shortly beforehand.
A waitress at the eatery claimed she arrived with a mystery man, talked about plastic surgery and stepped out of the way several times for an imaginary person.

A source previously said the What I Like About You star feels betrayed by her parents after they secretly arranged for her to be hospitalised again after she was accused of shoplifting and arrested for driving under the influence (DUI) last month.
The star spent five months in a treatment facility in July 2013 when she was placed under involuntary psychiatric hold for the first time.
She was released in December and appeared to be getting her life back on track until her previous conservatorship came to an end last month.
