Details of Mariah Carey's proposed pre-nup revealed

Los Angeles - Mariah Carey and James Packer were to state in writing if they were giving one another a gift.

The 'Hero' hitmaker - who recently split from the Australian billionaire - reportedly rejected a ''tacky and insulting'' pre-nuptial agreement drawn up by her then-fiance's legal team, as the document included strict conditions relating to clothing allowances, the use of private jets and the ownership of presents.

According to TMZ, one condition stated: ''Except for gifts between them for their engagement, wedding or on birthdays and anniversaries, no item of jewellery and/or personal adornment costing over $250 000 will be deemed a gift unless accompanied by, or promptly followed by, a writing specifically stating 'This is my gift to you.' ''

James also refused to foot the bill for Mariah's stage costumes or clothes for five-year-old Moroccan and Monroe, the twins she has with ex-husband Nick Cannon.
With a blank space left for a maximum amount to agree on, it states: ''the clothing is not to be used for business or performing and ''Mariah shall provide all clothing for her children.''

Elsewhere, the document stated: ''James shall cause a credit card(s) to be issued for use by Mariah and staff ... the amount of expenses ... shall not exceed US $____ per calendar month,'' with the amount left blank.

While James agreed to provide the 46-year-old singer with a ''private aircraft'', Mariah would only be allowed to use it when her partner felt it was ''appropriate''.
The document read: ''James shall provide the use of one private aircraft, of his selection, for Mariah's personal use, or that of her children and nannies only when James, in his sole discretion, determines it is appropriate to do so.''

But the main reason why negotiations were said to have broken down over the document was the amount the 49-year-old businessman wanted to pay Mariah if their union broke down.

The proposal suggested: ''James will pay Mariah, and Mariah shall accept, $6m dollars per year for each full year of marriage, up to a maximum of $30m ... adjusted pro-rata on a weekly basis ($151 385 per week).''

Sources said the One Sweet Day singer rejected the amount and James agreed to a $50m lump sum if they split.

Despite the outlandish document, it was previously claimed James wanted to marry Mariah even if she hadn't signed a pre-nuptial agreement.

A source previously said: ''He (James) felt that ultimately he didn't need a prenup. He was going to marry her (Mariah) without a prenup. He loved her so much and wanted to make her happy.''
