It seems that Judge Thokozile Masipa has set a precedent with the Oscar Pistorius rulling. Last month, Oscar was found not guilty of murdering his girlfriend, Reeva Steenkamp. He was instead found guilty of culpable homicide, as the judge believed that he had no intention to kill.
Molemo "Jub Jub" Maarohanye and his Themba Tshabala's murder convictions were overturned in the High Court in Johannesburg on Wednesday. The two's charges were instead reduced to culpable homicide, and instead of the initial 25 years in prison sentence, they will be serving 8 years. This means that they now have 6 more years to serve, this could be less if they get parole.
The judge found that there was no suggestion that Jub Jub and Themba could have foresight at the time of the accident as they were on drugs. The judge said the two should be dealt with as humans who have a possibility to be rehabilitated, and added that because they were on drugs at the time of the crash, they cannot be found guilty of murder.
