The convicted paralympian's legal team have labelled the state's appeal "deeply flawed."
This is according to eNCA, who are in possession of the court papers, in which Oscar's lawyers challenged the appeal.
'Oscar Pistorius' lawyers say the state's bid to appeal his murder acquittal is deeply flawed - and MUST be dismissed," eNCA legal journalist Karyn Maughan tweeted.
In the court papers, lawyers have reportedly argued that the State is appealing a factual finding about Oscar's intent when he fired shots not a legal finding.
"The state can only seek to appeal Judge Thokozile Masipa's legal findings, not her findings of fact," added lawyers in the court papers.
Oscar's lawyers argue that Judge Masipa found on facts put before her that the Blade Runner intended to shoot an intruder he believed was behind his toilet door but not to kill that person.
The defence lawyers have also argued that the state has failed to make a case that Oscar's five-year sentence was inappropriate.
The state's appeal application will be heard on 9 December.
